In a single page per curiam decision handed down today, the (U.S.) Supreme Court has not overturned the Ninth Circuit U.S. Court of Appeals ruling that the Copyright Act’s first sale doctrine applies only to goods first sold within the United States.

The Court’s 4-4 ruling (Justice Kagan was recused), means Costco will infringe Omega’s copyrights if it purchases Omega watches outside the United States and resells them in the US.

The case was Costco Wholesale Corp. v. Omega S.A., No. 08-1423, U.S. Sup.
